Judge Somers plans to challenge lawsuit ruling


DEARBORN — A motion challenging a jury verdict against the city’s top judge could be filed next week.

19th District Chief Judge Mark Somers said Friday that his attorney from the state Attorney General’s Office is working on a motion for judgment notwithstanding the verdict. A Wayne County jury last week found Somers fired former court probation officer Simone Calvas without just cause and awarded Calvas approximately $464,000 in past and future damages.

A judgment notwithstanding the verdict is an oft-requested but infrequently granted motion where a trial judge can exercise discretion to avoid extreme or unreasonable jury decisions. Literally, it allows the judge to enter a verdict notwithstanding a jury’s findings.
